THIS NOTICE DESCRIBES HOW MEDICAL AND NON-MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
This Privacy Policy explains how Generation Care Inc. and its affiliates (the “Generation Care”, “we”, or “us”) collect, use, share and protect information collected through our technology, applications, websites, content, products, and services in connection with the provision of medical and non-medical home care services (the “Services”). The person receiving care (the “Recipient”) may be you or another person for whom you have the authority to order Services, such as a parent or other relative.
1. INFORMATION WE COLLECT
We may collect the following kinds of information:
1.1. Information you provide
Generation Care collects information from you when you provide it to us. This happens when you register for our website, use the Platform, or communicate with us, such as through our website, applications, email, SMS, over the telephone or in person. The information you provide us may include information that personally identifies you (“Personally Identifiable Information” or “PII”), such as name, email address, phone number or your mailing address. We also collect your credit card information in order to process payments for Generation Care Services.
You may also provide us information about a person whose care is being managed through the Platform, such as that person’s Personal Information, conditions relative to the Generation Care Services, special needs and preferences. You agree not to provide us information about any other person unless you have that person’s express permission, or you are a legal guardian or have a power of attorney for that person.
Some of the information you provide us may relate to your past, present or future physical or mental health and related health care services. We will use the acronym “PHI” in this Privacy Policy when referring to “Protected Health Information.”
1.2. Information provided to the Generation Care Care-On-Demand
You or the Recipient may provide information to the Generation Care Care-On-Demand, including PHI. As part of the Services, the Generation Care Care-On-Demand will use Generation Care’s proprietary technology platform to manage and communicate with you about the Services that they are providing, including by entering information about the Services and the recipient of the services into the Generation Care application and websites, which will make it available to us.
1.3. Information based on standard web protocols
When you access our website through a browser, application or other client, like other web providers, our servers automatically record certain information. This data is recorded in server logs and may include information such as your web request, your interaction with the website, the website that you were visiting when you came to our website, your Internet Protocol (IP) address, your browser type and language, the date and time of your request, and your cookie data.
1.4. Cookies
While the generation-care.com domain does not currently use cookies when you visit our site, we may do so in the future. Cookies are used to remember information you have already entered, for instance a password, so that you will not have to re-enter them every time you visit. We will never use cookies to collect additional personally identifiable information about you. You can ask your browser to not accept cookies or to notify you when a cookie is being sent if you do not wish to accept cookies. You can also manually delete all cookie files from your computer. We would only use them to make you visit to our site more enjoyable.
2. USE AND DISCLOSURE OF INFORMATION
2.1.How We Use This Information
When you first register with us on the generation-care.com domain, we ask for your email address and name. Once you supply this information, you will be able to receive informative emails containing instructional articles, updates about our site, or offers and promotions. All information sent via email will come directly from generation-care.com, and you may call us or use the unsubscribe link in your email to remove your address from our list at any time. We will never sell or rent your information to anyone else. All information on current and former members is retained in our database solely for customer service and accounting purposes.
While Generation Care Inc. will never rent or sell your email address to parties unaffiliated with Generation Care Inc., we may at some point in the future allow advertising from 3rd party partners on our e-newsletter or website. Of course, you may unsubscribe at any time.
Also, we may occasionally offer surveys to help us better serve you. If and when you choose to participate in these optional surveys, you may also receive special offers via email. Any information you give us by taking part in a survey will be treated with the same strict concerns for privacy as all member information is treated.
2.2.Personally Identifiable Information
Generation Care may use and, if specifically noted, share your Personal Information and Personal Health Information “PHI” (together, your “Information”) for the purposes of providing you treatment, obtaining payment for our services and for the operation of our business. Your health information may be used or disclosed only after Generation Care has obtained your written consent. Generation Care has established policies to guard against unnecessary disclosure of your health information by employees, business associates or outside parties.
THE FOLLOWING IS A SUMMARY OF THE CIRCUMSTANCES WHERE YOUR HEALTH INFORMATION MAY BE USED AND/OR DISCLOSED WITH YOUR CONSENT.
- To Provide Treatment: Generation Care may use your information to coordinate care within the Agency and with your physician, therapist, case manager, pharmacist, medical equipment supplier, family, POAs and others who are legally appropriate to receive your health information.
- To Obtain Payment: Generation Care may disclose your health information to insurance companies as needed to obtain prior approval and to collect payment for care you received from the Agency.
- To Conduct Health Care Operations: Generation Care may use and disclose your health information for its own operations in order to facilitate the function of the Agency, and as necessary to provide quality care to all of the Agency’s clients.
- For Appointment Reminders: Generation care may use and disclose your information to contact you as a reminder that you have an appointment for a home visit.
- For Treatment Alternatives: Generation Care may use and disclose your health information to tell you about or recommend possible treatment options or alternatives that may be interest to you.
THE FOLLOWING IS A SUMMARY OF THE CIRCUMSTANCES AND PORPUSES FOR WHICH YOUR HEALTH INFORMATION MAY BE USED AND /OR DISCLOSED WITHOUT FIRST RECEIVING YOUR WRITTEN CONSENT.
- When Legally Required: Generation Care will disclose your health information when it is required to do so by any Federal, State or local law and law enforcement officials.
- Where There Are Risks To Public Health: Generation Care may disclose your health information for public activities and purposes in order to :
- Prevent or control disease, injury or disability and to report adverse events; to notify a person who has been exposed to a communicable disease or to who may be at risk of contracting or spreading a disease.
- Notify an employer about an individual who is a member of the workforce as legally required.
- To repost Abuse, Neglect Or Domestic Violence. Generation Care is allowed to notify government authorities if the Agency believes a client is the victim of abuse, neglect or domestic violence.
- To Conduct Health Oversight Activities: Generation Care may disclose your health information to a health oversight agency for activities including audits, civil administrative or criminal investigations, inspections, licensure or disciplinary action.
- In Connection With Judicial And Administrative Proceedings: Generation Care may disclose our health information in response to an order of a court or administrative tribunal as expressly authorized by such order or in response of subpoena, discovery request or other lawful process.
- To Coroners and Medical Examiners: Generation Care may disclose your health information to coroners, medical examiners, and funeral directors of determining your cause of death and making funeral arrangements.
- For Organ, Eye, Or Tissues Donation.
- For Research Purposes.
- For Workers Compensations. Generation Care may release your health information for worker’s compensation or similar programs.
- For Specified Government Functions. In certain circumstances, the Federal regulations authorize the Agency to use or disclose your information to facilitate specified government function.
- If you are a member of the armed forces or a veteran, as required by military authorities.
- With our business associates, companies with whom we have contracted to provide services on our behalf, such as web hosting services, application development, analytics, security, data processing, legal, actuarial, accounting, management, administrative, accreditation, data aggregation or financial services. These companies are obligated through agreements to maintain the confidentiality of any Personal Information and PHI they receive from us and are restricted from using it for any purpose that is incompatible with the uses set forth in this Privacy Policy.
- To evaluate the quality of our services, to train our employees, to create and monitor record keeping and to assess the financial performance of our agency.
- If Generation Care undergoes any merger or sale of its stock or some or all of its assets, we may transfer your Personal Information to the successor entity so long as it continues to maintain that information in accordance with the Privacy Policy under which it was collected. We will comply with any other PHI disclosure rights, obligations, or processes not specified above if required or permitted by law. We will obtain your written authorization before using or disclosing your PHI for purposes other than those provided above or as otherwise permitted or required by law. You may revoke an authorization in writing at any time. Upon receipt of a written revocation, we will stop the use or disclosure covered by the authorization except to the extent of actions already taken in reliance on the authorization.
AUTHORIZATION TO USE OR DISCLOSE YOUR HEALTH INFORMATION
Other than is stated above, Generation Care will not disclose your health information without your written consent. You may revoke that consent in writing at any time.
2.3. Credit/Debit Card Information
Credit/debit card information is never shared with outside parties for promotional purposes. When you purchase our services, we will ask for your billing address, your phone number and credit/debit card information.
- YOUR RIGHTS WITH RESPECT TO YOUR HEALTH INFORMATION
You have the following rights related to your health information in our possession or control but if and to the extent that the Services are covered by the Health Insurance Portability and Accountability Act (HIPAA) of 1996:
- Right to request restrictions. You may request restrictions on certain uses and discloses of your health information. Request non-disclosure of your health information by email your request to [email protected]
- Right to receive confidential communications. You have the rights to refuse any persons others than yourself to have access to your health information.
- Right to inspect and copy your health information. You have the right to inspect and copy your health information.
- Right to amend health information. You or your legal representatives have the right to request that Generation Care amends your records, if you believe that your health information is incorrect or incomplete. Generation Care may deny that request if it is not in writing or does not include a reason for amendment. The request also may be denied if your health records were not created by the Agency.
- Right to an accounting. You or your legal representatives have the right to request an accounting of disclosures of your health information made by Generation Care for any reason other than for treatment, payment or health care operations. The request should specify the time period for accounting starting on or after April 14, 2003. Six (6) years is the maximum period of time for the request.

4. CHANGES TO THIS PRIVACY POLICY
Any changes to this policy will be posted at this URL: www.generation-care.com. We will not use data we collect in a manner that is materially different from promises made in the version of the Privacy Policy under which it was collected without your consent.
5. UPDATING YOUR PERSONAL INFORMATION
You can contact us by emailing us at [email protected] and we will make good faith efforts to provide you with access to your Personal Information in order to correct, amend, or delete it unless prohibited by law. We may decline to process requests if it would require effort disproportionate to the privacy risk and would violate the rights of others or would prejudice an ongoing legal proceeding or investigation. Because of the way we make back-up copies of our data, residual copies of the information may remain in our backup systems. We also may not be able to delete Personal Information that you have submitted through public activities, and even after removal and it may remain viewable in cached and archived locations or on other websites not within our control. We may charge a reasonable fee to access your Personal Information if to do so would require disproportionate effort. Updating or deletion of your Personal Information will not have any effect on other information that Generation Care maintains.
6. SECURITY
We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline.
Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a closed lock icon at the bottom of your web browser, or looking for “https” at the beginning of the address of the web page.
While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (e.g, charting, billing or customer service) are granted access to personally identifiable information. The computers/servers on which we store personally identifiable information are kept in a secure environment.
We recognize that security is important and take reasonable measures to protect your Personal Information from loss, misuse or unauthorized access, disclosure, alteration or destruction. 7. COMMUNICATING WITH YOU
7.1. Emails and other notifications
You agree that Generation Care Inc. may send you communications relating to your account and the Generation Care Services. These communications may be through email, telephone, SMS or notifications through applications. You can elect not to receive certain marketing messages from Generation Care by email by following the instructions in the email or by contacting us, but you cannot elect not to receive administrative messages relating to your account or legal matters. You consent to receiving all legally-required notifications from Generation Care through display on our website, through the email you provide to us, or through the email associated with your Generation Care account, which may be the email associated with any of your third-party IM Websites or social networks through which you connect to Generation Care (such as Facebook).
7.2. Comments, Questions and Complaints
Generation Care periodically reviews its privacy practices and this Privacy Policy. We encourage interested persons to raise any concerns using the contact information provided below and we will investigate and attempt to resolve any concerns or complaints.
